Welcome to Lekondo! We're excited to have you join our community. These Terms of Service ("Terms") outline your rights and responsibilities when you use the Lekondo mobile app, website, and our related features (collectively, the "Services"). Please take a moment to read them. By using Lekondo, you're agreeing to these Terms. Our goal is to create a positive space for sharing and discovering visual inspiration.

1. Your Lekondo Account

To use certain features, you'll need to create an account. Please provide accurate information and keep it current. You are responsible for activities under your account, so please keep your login details secure. If you suspect any unauthorized use or lose access to your account, let us know right away.

2. Sharing Your Images & Content

Lekondo is a platform for you to upload and share your images, tags, comments, and other creative content ("User Content").

Visibility and Your Choices

By default, images you post are private to the Lekondo community. You have control and can adjust privacy settings for your posts. Content marked private will not be shown to other users or used in our marketing without your permission.

Your Ownership and Our License to Operate

You always own the rights to your images and content. However, by posting on Lekondo, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings). This license ends when your content is deleted from our systems. You can delete content individually or all at once by deleting your account.

You are responsible for the content you share. Please ensure you have the necessary rights to upload it and that it doesn't infringe on anyone else's rights or violate any laws.

3. How We Use Data

We collect certain data to operate and enhance Lekondo. Our Privacy Policy provides detailed information on this. Your use of Lekondo signifies your understanding of these data practices.

4. Community Guidelines & Responsible Use

To keep Lekondo a positive and safe environment for everyone, please agree not to:

Violate any applicable laws or regulations.
Post content that is harassing, defamatory, hateful, explicit, or discriminatory.
Upload viruses, malware, or spam.
Attempt to scrape, reverse-engineer, or disrupt our platform or code.
Use Lekondo or its content to train a competing AI model without our explicit prior consent.

We believe in creative expression, but not at the expense of others' safety or well-being.

5. Our Intellectual Property

The Lekondo name, logos, app design, website, and the underlying technology are ours and protected by intellectual property laws. We grant you a license to use our Services as intended, but you may not copy or distribute these assets without our written permission.

6. Subscriptions & Payments

Some Lekondo features may be part of a subscription or require payment. If you subscribe, you authorize us to charge your chosen payment method. Subscriptions typically auto-renew unless you disable auto-renewal at least 24 hours before the current period ends. Applicable local taxes may be added.

7. Content Removal & Account Termination

We reserve the right to remove any content or suspend or close accounts if these Terms are violated, if required by law, or to protect our community or services. This includes cases involving intellectual property infringement, legal exposure, or misuse of our platform.

We will strive to notify you if such action is taken, but we may act without notice in urgent or legally required circumstances.

If you delete your account or specific content, we will begin the deletion process within a reasonable time. However, some content may persist temporarily in backups or due to technical limitations. In some cases, we may retain content for longer where required by law, to comply with legal obligations, preserve evidence, resolve disputes, enforce our agreements, or protect our users and services.

Content that has been shared with others or reused in accordance with your privacy settings may continue to exist on the platform until deleted by those users.

You can request to delete your account at any time by contacting us.

8. Limitation of Liability

We work hard to provide a great service, but like any online platform, we can't guarantee it will always be perfect. To the extent permitted by law, Lekondo and its team will not be liable for indirect or consequential damages. Our total liability to you in any 12-month period will be the greater of $100 or the amount you paid us in that period, if any.

9. Disclaimer

Lekondo is provided on an "AS IS" and "AS AVAILABLE" basis. This means we don't make specific promises about its availability, reliability, or that it will be error-free. To the extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We are not responsible for the conduct, content, or services provided by other users or third parties you may interact with through Lekondo.

10. Indemnification

You agree to defend, indemnify, and hold harmless Lekondo, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your content, your use of the Services, or your violation of these Terms.

11. Arbitration and Class Action Waiver

To the fullest extent permitted by law, you and Lekondo agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. This means you and Lekondo each waive the right to a trial by jury or to participate in a class action lawsuit or class-wide arbitration.

Exceptions

Either party may bring individual claims in small claims court. This arbitration agreement does not apply to disputes relating to intellectual property rights or to claims that cannot be subject to arbitration by law.

Opting Out of Arbitration

You may opt out of this arbitration agreement within 30 days of first agreeing to these Terms. To do so, email us at arbitration-optout@lekondo.com with:

Your full name
The email address associated with your Lekondo account
A clear statement that you wish to opt out of arbitration

This opt-out will not affect any other part of these Terms. If you do not opt out, this arbitration agreement will remain in full force and effect and will survive termination of your account or these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware. Any disputes will generally be handled in the state or federal courts located in New York County, New York, unless we mutually agree to an alternative like arbitration.

13. Changes to These Terms

We may change our Service and policies, and we may need to make changes to these Terms so that they accurately reflect our Service and policies. Unless otherwise required by law, we will notify you (for example, through the Service) before we make changes to these Terms and give you an opportunity to review them. If you continue to use Lekondo, you will be bound by the updated Terms.

14. Feedback and Suggestions

We appreciate your ideas, feedback, and suggestions. By submitting them, you agree that we may use them without restriction or obligation to compensate you, and we are under no obligation to keep them confidential.

15. General Provisions

If any aspect of this agreement is unenforceable, the rest will remain in effect.

Any amendment or waiver to our agreement must be in writing and signed by us. If we fail to enforce any aspect of this agreement, it will not be a waiver.

We reserve all rights not expressly granted to you.
